EightCap Regulation: What Traders in Pakistan Need to Know

EightCap does not currently serve Pakistan. According to available reporting, it is treated as an unsupported market, and there is no verified pathway for onboarding Pakistani residents.

This page explains the regulatory picture around that fact: who operates the broker, what protections exist, and the specific regulatory landscape in Pakistan that shapes your options.

The Licensing Reality

EightCap Pty Ltd is headquartered in Melbourne, Australia, and was founded in 2009. It is a global forex and CFD broker known for MT4, MT5, and a wide crypto CFD range. The brand operates under several legal entities, with oversight from regulators like the Australian Securities and Investments Commission (ASIC) in Australia, the Financial Sector Conduct Authority (FSCA) in South Africa, and the Cyprus Securities and Exchange Commission (CySEC) in Europe.

EightCap does not hold a license from the Securities and Exchange Commission of Pakistan (SECP). The SECP regulates capital markets and derivatives but does not currently issue local retail spot-forex or CFD broker licenses. No international broker is officially licensed to operate "inside" Pakistan by the SECP.

This is not unique to EightCap. It is standard for the whole category of international brokers serving Pakistani residents. You are always trading with an entity regulated abroad, not one licensed in your home country.

Pakistan’s margin trading ban

The State Bank of Pakistan (SBP), which oversees foreign-exchange policy under the Foreign Exchange Manual (FERA 1947), does not permit margin-based currency trading within Pakistan. Because forex and CFD trading involves margin, it falls into a gray area.

The SECP has been active in issuing warnings and cracking down on unlicensed currency and commodity-futures operators (2026). This environment makes it costly for many international brokers to set up onboarding for Pakistani clients.

The practical effect: you cannot open an account with EightCap from Pakistan, regardless of how good their platform or spreads are. Your first filter when choosing any broker is simple: does it accept clients from Pakistan?

What Protections Exist

Protection for a retail trader comes from the regulator that supervises the broker's entity. When you trade with an FCA, ASIC, or CySEC-regulated broker, you get rules about client fund segregation, negative balance protection (in some regions), and access to compensation schemes.

For EightCap, this protection is designed for clients in the regions where they are licensed, not for Pakistan. Since Pakistan is not served, those protections do not extend to you. For the brokers that do accept Pakistani residents, you must check which entity you are being onboarded with.

A broker's regulatory disclosures should state:

  • Client funds held in segregated accounts
  • Regulator name and license number on the website
  • Jurisdiction of the entity that holds your account
  • Whether negative balance protection applies
  • Which compensation scheme covers you, if any

The Pakistani Regulatory Framework

The financial regulatory picture in Pakistan has two main bodies. The State Bank of Pakistan (SBP) controls foreign exchange and the movement of money across borders. The Securities and Exchange Commission of Pakistan (SECP) regulates securities, derivatives, and capital markets.

Neither authority issues licenses for local retail spot-forex or CFD brokers. SBP does not permit margin-based currency trading within Pakistani borders. Trading with an offshore broker is the only option if you want to trade forex or CFDs.

Retail forex and CFD trading is not criminalized. Residents may trade via offshore brokers regulated abroad, like FCA, ASIC, or CySEC entities, provided the funds go through legitimate banking channels. Using Hawala or Hundi networks, or unregulated platforms that bypass the banking system, is illegal.

WARNING
The legal line in Pakistan is about the money flow, not the trading itself. Always fund your account through documented bank transfers or registered payment services. Avoid unlicensed money remitters.

Practical Differences in Trading Conditions

While EightCap is not available, understanding what their standard conditions look like helps you benchmark other brokers that do accept Pakistan.

SpreadsFrom 1.0 pipFrom 0.0 pips
CommissionNoneUSD 3.50 per lot per side
Min. DepositUSD 100USD 100
PlatformsMT4, MT5, TradingViewMT4, MT5, TradingView

EightCap offers over 800 CFDs, including about 56 forex pairs, indices, metals, energies, roughly 580 share and ETF CFDs, and a crypto range of over 100 coins. They also support WebTrader and TradeLocker.

If a broker offers a "Raw" account with zero spreads but charges a hidden fee elsewhere, you can spot it. If another broker charges a commission but offers tight spreads, you can calculate which works better for your trade size.

The key number for your own planning is the minimum deposit. In Pakistan, broker accounts are typically denominated in USD, not PKR. You will pay a currency conversion cost when you fund the account.

The Islamic Account Question

Because Pakistan is a Muslim-majority country, swap-free or Islamic accounts are a default requirement for most retail traders.

For Eightcap, reporting is conflicting. A dedicated swap-free or Islamic account is not consistently offered and this was not verified at the time of review. This matters even though the broker does not serve Pakistan. It shows that even brokers with good reputations do not always have the features Pakistani traders need.

Across the industry, of 59 brokers covered in one review of Pakistan, 55 offered an Islamic account. Exness, XM, FXTM, and Octa prominently offer swap-free accounts to Pakistani clients. If a broker does not mention a swap-free account, ask support directly before depositing.

The Tax Angle for Traders

Trading profits in Pakistan are generally taxed as income, or as capital gains on movable assets at the individual's normal slab rates. There are specific rates for listed securities and foreign shares. The Federal Board of Revenue (FBR) is the tax authority.

Income from foreign sources is taxed on a worldwide basis for residents. The tax year ends June 30. A Foreign Income and Assets Statement is required if foreign income exceeds USD 10,000 or foreign assets exceed USD 100,000 in the tax year.

Tax ItemRate / Rule
Trading profit (income)Normal slab rates
Foreign shares / mutual funds~15% flat
Crypto gains15% flat as of review
Foreign asset statementRequired > USD 100,000

Reporting your income to the FBR is your responsibility. A broker's regulatory status does not change your tax obligations.

Where the Risk Sits

A regulatory warning zone exists on the following: unlicensed forex or MLM schemes, Ponzi structures promising fixed high returns, Telegram and WhatsApp signal groups, and clone broker apps. The SECP issues alerts about these. There is no consolidated public blacklist like RBI's Alert List, so you must check SECP alerts and SBP notices yourself.

The common scams are not about regulated brokers. They are about fake platforms. A clone of a real broker, a signal group, or a Ponzi scheme will steal money. Legitimate international brokers will not promise fixed returns. They will not ask you to send funds via Hawala.

Warning signs to act on:

  • Guaranteed returns or fixed monthly income promised
  • Pressure to deposit quickly via WhatsApp or Telegram
  • No clear regulatory license number on the website
  • Payment only via personal bank accounts or crypto wallets
  • No identity verification (KYC) process

KYC matters. To open any legitimate account, you will need a clear photo of your CNIC or passport, plus proof of address like a utility bill or bank statement.

GOOD TO KNOW
If a broker does not ask for KYC documents, that is a red flag. Legitimate regulated entities require identity verification to comply with AML rules.

Where to Draw the Line

Trading with an international broker is a reasonable choice for a Pakistani resident, provided you pick the right one. The boundary of sensible risk is not about "offshore equals bad." It is about whether you, as the client, have a clear contract, a licensed entity, and a funded account through legal rails.

A broker should have regulation from a recognized authority like FCA, ASIC, or CySEC, explicitly accept Pakistani clients, offer an Islamic account if that is your requirement, and have transparent costs with no hidden fees.

Checklist ItemWhy It Matters
Accepts Pakistan clientsWithout this, onboarding will fail
Strong foreign regulatorFCA / ASIC / CySEC preferred
Segregated client fundsProtects your capital
Islamic account offeredMost Pakistani traders require this
Clear KYC processLegitimacy and AML compliance

If a broker fails any of these tests, move on. If the regulation is from an unverifiable offshore zone, that is your line. If they do not accept Pakistan but look great, they are useless to you. If there is no swap-free account, most local traders will not stick around.

Use these criteria as your filter, not the marketing flash. The best platform in the world does nothing for you if you cannot fund it legally from Pakistan.
